Solid Wood Floor Dilemma

We recently tasked a contractor to install a solid maple wood floor on top of our existing linoleum floor. The subfloor is 3/4" plywood with a layer of 1/4" luan plywood. A contract was never signed since we were in a rush to complete this job and scheduling with the contractor was "now or never". The floor was laid beautifully in only a day. Only problem... it was laid parallel to the joists. It was our understanding it would be laid perpendicular to the joists. We asked the contractor to re-do the floor. However, now he won't even return our calls. We are pursuing legal action. Would it be wrong to keep and finish the floor the way it is now? Will we experience problems with this floor years from now? Tim D.
