Oversight in foundation design

During the early phase of our project, our general contractor discovered that our lot is not level as is assumed in the plans. As a result, we had to add a higher foundation and are forced to spend some extra money to deal with this grading problem.

Is there anything we can do to recover some of this cost from our designer?
